The federal appeals court decided on Tuesday that it would reexamine the case concerning the executive power with an larger panel of eleven justices. The court also overturned a earlier decision from a three-judge panel that had sided with the federal government.

This legal directive represents the most recent turn in a protracted court case over whether the former president has the legal right and valid reason to send state military units in the city. Approximately two hundred troops have been in uncertainty since late September when the mobilization attempt was initiated in due to ongoing demonstrations.

The Tuesday ruling came after a federal judge in Portland issued two temporary restraining orders this period – one preventing the federalization of the state troops, and another prohibiting the deployment of any military personnel in the state, after efforts to evade the first order by calling up troops from California.

On the previous day, the ninth circuit panel had put the first ruling on hold – allowing command of 200 Oregon national guard – but the second ruling remained in place, preventing the physical sending of the forces.
